Fines for legal entities in 2018
Imposing penalties on legal entities is the most common form of administrative punishment. Fines are provided by the majority of articles of the Administrative Code and other legislative acts.
Legal entities can punish for a lot. In particular, in 2018, the punishment was imposed for non-use of cash registers and the lack of an online ticket office, for the absence of a tachograph on vehicles - passenger buses and heavy vehicles, for violations by the managing organizations of placing information on the GIS utilities website.
In accordance with Part 2 of Article 14.5 of the Code on Administrative Offenses, in the event of non-use of CCV, a fine of ¼ to ½ of the amount of the calculation amount is imposed on officials and individual entrepreneurs, but not less than 10 thousand rubles. For legal entities without the use of CCT, the law provides for a fine from ¾ to one size of the calculation amount using cash or electronic means of payment, but not less than 30 thousand rubles.The same amount of the fine is imposed for work without a cash register, for a check that has not been made at the checkout counter, and also for the absence of an online cash register.
If the amount of the calculation without the use of CCP amounted to 1 million rubles or more, for repeated violation in accordance with part 3 of article 14.5 of the Administrative Code of the Russian Federation for officials is disqualified for a period of one to two years. In relation to legal entities and individual entrepreneurs, administrative suspension of activity is applied for up to 90 days.
As for the tachograph on vehicles, the traffic police inspector may issue a fine:
- for the absence of the device,
- for trying to block it,
- for trying to adjust his work,
- for an inadequate device;
- for a digital tachograph not reinforced by the SKZI unit,
- for an AETR tachograph without a UK access card for international transport,
- for analog tachograph.
In 2018, the amount of punishment in this case, in accordance with Article 11.23 of the Administrative Code of the RF, will amount to 5,000 rubles to 10,000 rubles for officials (legal entities). For citizens, the amount of the fine is slightly less - from 1,000 to 3,000 rubles. The same amount will be paid by the driver who violated the regime of work and rest.
Installation of obviously forged state license plates on a vehicle is fraught with a large fine. According to part 3 of article 12.2 of the Code of Administrative Offenses, a legal entity in this case is entitled to punish 400,000 - 500,000 rubles. The penalty on the official for this violation is 15000-20000 rubles.
The management company has the right to punish if it:
did not post the information on the portal GIS utilities,
posted information is not in full or in a deliberately distorted form,
violated the methods, terms or procedure for posting information.
For violation of these requirements in accordance with Article 13.19.2 of the Administrative Code of the Russian Federation, a fine of up to 5,000-10,000 rubles is envisaged. Earlier - before the adoption of the Federal Law of 29.12.2017, No. 437-ФЗ “On Amendments to the Code of Administrative Offenses of the Russian Federation” - this amount was significantly higher - 30,000 rubles.
